Creation of NATO SEA
With the countries of Finland and Sweden floating the idea around of creating a NATO sea in the 'Gulf of Finland the stretch of sea between Sweden and Finland to deter Russia, one is left to consider what implications this might have on the international community or other state's behavior.
The United Nations which was created to find ways to avert wars upon the suggestion of the United States has an arm which has created the Laws of the Seas Convention which according to UN.org "to ensure the peaceful, cooperative, legally defined uses of the seas and oceans for the individual and common benefit of humankind."
There are some questions of issues which should be considered with respect to forming of the NATO SEA as suggested by the two nations:
First, have they taken into consideration how this might affect other nations with similar territory as we consider the conflict between Russia and Ukraine today?
Second, based on the laws there is the EEZ - Exclusive Economic Zone which extends up to two hundred miles offshore with the waters being international and the seabed being that of the state.
With the conflict between Russia and Ukraine and the United States is continuously making reference to the Cuban Missile Crisis - the creation of the NATO SEA one sees similarities between the two and even go as far as looking in terms of hosting nuclear weapons in non-nuclear states by the United States through permissive agreements on their bases. With the Ocean and Seas Convention one can see the Soviet's having a genuine argument where the hosting of missiles or submarines anchored on the country's seabed through permissive agreements could be used as leverage or another similar Cuban Crisis. Using the fact that the United States' situation with Italy a non-nuclear state hosting US nuclear missile on it shores - military bases.
Also, with China itself having its first military base outside China utilizing "permissive hosting" similar to the United States' to afford them to host nuclear weapons on these bases in these non-nuclear states - this is equivalent to the cold war era with the Soviets.
